This paper is a supremely interesting, and lay-reader friendly, analysis of the fair use claims of large language models and their training on copyrighted materials. It lands on a conclusion that LLMs can not justifiably claim fair use, primarily because the technology by its very nature incorporates the material it is trained on, regardless of whether it can be enticed to regurgitate copies of it verbatim (and many examples have shown it can).
